5. Accuracy of content
Lomond Cyber aims to ensure that all content on this website is accurate and up to date. However, we do not warrant that the content is error-free, complete or current at all times. From time to time there may be typographical errors, inaccuracies or omissions.
We reserve the right to correct any errors or omissions and to update information at any time without prior notice. The digital threat landscape changes rapidly and guidance that was accurate at the time of publication may become outdated. We recommend that you contact us directly for the most current advice.
6. Our services
Lomond Cyber provides cybersecurity and digital safeguarding services to private clients and schools. Our current services include, but are not limited to, group workshops, private courses, individual assessments, family assessments, staff training, parent workshops, policy review, and designated safeguarding lead support.
The specific scope, format and deliverables of each engagement will be agreed with you prior to commencement and confirmed in writing.
7. How a contract is formed
A contract for services is formed when we have received your deposit payment and confirmed your booking in writing by email. Our confirmation will set out the agreed scope of services, fees and scheduled dates.
No contract exists by virtue of an enquiry, quote or provisional discussion alone. We reserve the right to decline any engagement at our discretion prior to confirmation.
8. Fees and payment
Our fees will be agreed and confirmed with you prior to booking. Unless otherwise agreed in writing, the following payment terms apply:
- Deposit: a non-refundable deposit of 50% of the agreed fee is due at the time of booking to secure your service date.
- Balance: the remaining 50% is due no later than 7 days before the scheduled service date.
- Late payment: if the balance is not received by the due date, we reserve the right to cancel the booking and retain the deposit.
All fees are quoted inclusive of VAT where applicable. Invoices are payable by bank transfer. Payment details will be provided on your invoice.
For school partnership arrangements, bespoke payment terms may be agreed in writing and will take precedence over the above.
9. Cancellation and refunds
Your right to cancel (statutory cooling-off period)
Where a contract is formed online or away from our business premises, you have the right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel within 14 days of the contract being formed, without giving any reason.
However, if you have requested that services commence within this 14-day period, you acknowledge that your right to a full refund may be reduced proportionally to reflect any services already delivered.
To exercise your right to cancel within this period, please contact us in writing at info@lomondcyber.com.
Cancellation after the cooling-off period
After the 14-day cooling-off period, the following cancellation terms apply:
- Cancellation more than 14 days before the scheduled date: deposit forfeited; balance (if already paid) refunded in full.
- Cancellation between 7 and 14 days before the scheduled date: deposit forfeited; 25% of the balance is due if not already paid.
- Cancellation within 7 days of the scheduled date: the full fee becomes payable.
We understand that circumstances can change. Where possible, we will always try to accommodate rescheduling requests in lieu of cancellation, at our discretion and subject to availability.
Cancellation by Lomond Cyber
In the unlikely event that we need to cancel a confirmed booking, we will notify you as soon as possible and offer either a full refund of all sums paid or an alternative date. We will not be liable for any further losses arising from our cancellation beyond the refund of fees paid.
10. Nature of our services
Lomond Cyber provides professional advisory and educational services in the field of cybersecurity and digital safeguarding. Our services are designed to help individuals, families and institutions understand digital risks and take practical steps to protect themselves.
All services are delivered with reasonable professional care and skill. However, you acknowledge and agree that:
- our services are advisory and educational in nature only, and do not constitute a guarantee of any particular outcome or level of protection;
- implementation of any recommendations, guidance or action plans provided by us is your responsibility;
- the digital threat landscape is constantly evolving, and guidance that is accurate and appropriate at the time of delivery may become outdated over time;
- we are not responsible for the actions or decisions of third parties, including but not limited to technology platforms, social media companies, or other individuals.
11. Safeguarding and limitations of advice
Lomond Cyber has expertise in digital safeguarding and takes its responsibilities in this area seriously. Where we work with or in relation to children and young people, we hold appropriate qualifications and DBS clearance as required.
However, our role is to provide advice, guidance and education - we are not a regulatory, law enforcement or statutory safeguarding body. We cannot and do not guarantee that following our guidance will prevent any specific incident, harm or offence, including but not limited to cyberbullying, online exploitation, fraud, or other digital harms.
If you become aware of an immediate safeguarding concern involving a child, you should contact the relevant statutory authorities (such as the police or local authority children’s services) without delay. Our advice does not replace statutory safeguarding processes.
12. Confidentiality
We understand that the information you share with us in the course of an engagement may be personal and sensitive. We treat all client information with strict confidence and will not disclose it to any third party except:
- where you have given your consent;
- where we are required to do so by law or a court order;
- where disclosure is necessary to protect the imminent physical safety of a child or vulnerable person.
We ask that you treat any materials, methodologies or proprietary information shared by us in the course of an engagement as confidential and do not share them with third parties without our written consent.
13. Limitation of liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
Subject to the above, and to the fullest extent permitted by law:
- our total liability to you in connection with any engagement shall not exceed the total fees paid by you for that engagement;
- we shall not be liable for any indirect, consequential, special or punitive losses, including loss of profit, loss of data, loss of opportunity, or any harm arising from a specific incident or event that our advice was intended to help prevent.
These limitations reflect the advisory nature of our services and the fact that outcomes depend substantially on factors outside our control, including your implementation of our recommendations and the behaviour of third parties.
Where you are a consumer, these terms do not affect your statutory rights under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.
14. Data protection
We take the protection of your personal data seriously. Our Privacy Policy, available at lomondcyber.com, explains how we collect, use and protect your personal data in accordance with the UK GDPR and the Data Protection Act 2018. By engaging our services, you confirm that you have read and understood our Privacy Policy.
15. Changes to these terms
We reserve the right to update these terms at any time. The current version will always be available on our website. For existing confirmed engagements, the terms in force at the time of booking will apply unless we agree otherwise in writing.
